In light of all of the threads I read on this forum and on others and with a touch of law knowledge from back in the day I would like to present you with this thread to help you get out of or at least minimize damage when being pulled over. This is good info so please take it in.
Traffic cops are trained to give tickets for the state/town/city they work for. This is for many reasons. As such the things they say to you at your vehicle come mostly from training in order to expidite the process of you getting a ticket. Here are some things to help you get around getting a ticket.
Be polite. As much as you may hate cops or the system they work for be polite. Call him officer or sir. Calling him man, dude, etc will irritate him and you will most likely get the ticket.
When the officer confronts you at the initial contact, they will first ask for your reg. and drivers license. Have these ready before he gets to the cars as to expidite the process. While doing this, DO NOT roll your window all the way down. Roll it down just far enough to hand him the reg. and license. When an officer is making his first contact he is trained to see and smell anything illegal in your car. You can’t really do anything about the sight aspect of it. However, the officer can say he smells marijuanna even if he dosen’t in order to search your car. If you only have the window rolled down enough to hand him the necc. items, it will make it difficult if not impossible for him to be able to say he smelled marijuanna or alcohol in your car. As far as court appearances go.
After this is done, the cop is trained to ask you why you think you were pulled over. This is where you can beat him at his own game. Never ever say, I don’t know or actually disclose the reason, even if you know you did something wrong. To counter is question, you answer with a question and if you don’t, the game is over and he wins.
Example:
Incorrect: Officer - “Do you know why I pulled you over?”
You - “I don’t know sir”
Correct: Officer - "Do you know why I pulled you over?"
You - "Did I do something wrong officer?"
The first example shows negligence on your part because you may have unknowingly done something wrong. The second example will make the officer have to tell you why he pulled you over not the other way around. This will come in handy if you decided to fight the ticket if you get one.
If the officer asks you to get out of your vehicle for ANY reason. You must oblidge. As you get out of the car make sure you grab your keys and lock the door. This makes an illegal search impossible because he would now HAVE to ask you for you keys in order to get in the car, in which you have a full right to say no. If you consent (which I reccomned not to do) to the search he may place you in handcuffs and ask you sit down. Don’t worry you are NOT under arrest. This is for his safety.
After all is said and done, if he hands you a ticket and you know you are in the right and he is in the wrong, DO NOT argue with him. A police officer has the right to write you a ticket for ANY reason, at ANY time. It is up to the court to decide whether to prosecute. Fight him in court not in the street. This will result in multiple tickets and/or arrest.
Something we all can do irregardless of what you think you may have heard is have a recording device installed in your car. Whether it be camera or just audio recording. It IS NOT illegal to record a transaction between you and a police officer ever. The right to privacy does not exist in this situation for many reasons. If you record something that may get you off the hook, you may use this recording to fight the ticket and/or arrest.
So with all of that said, I hope this helps you out next time you get pulled over. I interned at the Warren County DA’s office for a year and learned a lot about this BS. Hence why i do not have anything on my driving abstract other than a cell phone violation, which you can’t really get out of when you are on their dashcam :confused
The only thing I would have to say I have been told otherwise on is having the license and registration ready…
I always used to do it that way, until a family friend who is a police officer pointed out that for the officer’s safety if they see you moving around in the car it may get them nervous. He let me know it is best to wait for the officer to get to your car, then let him know where each item is and you are getting them. So…
Officer: “License and registration…”
You: “Yes officer, my license is in my … (wherever, wallet, console, etc.) and my registration is in the glove box. Let me get them for you…”
I don’t think answering a question with a question to an officer is a good approach either. If you clearly know you did do something wrong and answer like that, you’re still lying and look like an idiot, atleast in my eyes.
If you truly don’t know what you were pulled over then i’d say its ok to go with what you said.
He said 9x out of 10, if say you were speeding, and you were honest about it, he would let the people go. But if they tried to play games and dance around it, he gave them a ticket every time.
ya if it was obvious why u got pulled over cuz you smoked passed a cop 40 mph over the limit then yea you should just be like… I was speeding officer. haah
BUT answering a question with a question is not stupid at all, that not only applies to this gettin pulled over stuff but in alot of things, I been taught to answer questions with questions and keep control of the conversation and since then its made things alot easier no matter what it is…
If an officer pulls me over I WILL ask him if I did something wrong, there is no problem with that, the whole I DONT KNOW thing is just retarded
BUT getting your shit out before the cop gets to your window… uh? anyone see anything wrong with that hahaha getting your regey or your gun… wtf does the cop know ? exactly i wouldnt do it my self probably wind up with a slug in my head
Yeah… I meant the speeding thing to be kind of like an exception where you shouldn’t play that game.
And I have always asked if I did something wrong every time I got pulled over for anything other than speeding.
Got me out of alot of tickets to be honest.
i keep my registration folded behind my ID in my wallet, and my insurance card folded in the consol or the ash tray, cause i dont smoke. So when i get pulled over i grab my wallet, id, reg, and insurance card, and i have all 3 without really moving by the time he comes up to the car. but i don’t give them to him until he asks, and i ask what i did wrong.
The problem with doing that, especially moving around in your car to get your insurance, id, registration is going directly back to what Nicole stated. They see you moving around they may think your trying to hide something or potentially grab a weapon. Yea, it sounds crazy to ever think a normal and completely rational person would do something like that but there are plenty of crazy people in this world that would be stupid enough to try to kill a cop.
I don’t think any cop would really give you shit for it - I just wouldn’t want an rookie who’s already nervous and jumpy on edge getting even more freaked out or something…
i would never get my id and everything out before he asks for it, i clearly do it and tell him what i am doing when i reach for them. Its also good to turn your vehicle off and slowly put your keys on your dash where they can see them and keep your hands on the wheel. These have gotten me out of many tickets using this info and some other good stuff.
I think cops are alot more willing to be nicer to you when they see those kind of things.
It shows you most likely know someone in law enforcement who told you what to do, and I feel like it gives them alot more respect for you just by you showing them some respect.
If i was a cop and someone said “Did I do something wrong officer?” i’d give them a ticket for trying to suck up or for acting stupid when they know they did something.
I usually just admit to them what I did if I know that he clearly saw me and have been let off because of that. I don’t usually fuck around so I don’t worry about getting pulled over and having to act innocent to get out of it.
Have anyone here ever done a ride along with a cop? Or are directly related to one? I work with troopers, every day and have been on ride alongs, grew up with a kid who is now a cop, and have been pulled over allot.
I have gotten a shit load of tickets, and I have also been warned or let go on a shit load of incidents. This is a quote from the mouth of an officer… “If I want to give someone a ticket I will do it”. The only sure fire way you will get out of a ticket, is if the cop doesn’t want to give you a ticket. I watched people get pulled over, played all the games, respected the officer, yes, sir, no sir, everything mentioned above. The officer came back to the car and said quite literally, “Fuck it she is getting a ticket anyway”. They honestly don’t give a shit one way or another.
It isnt worth it to me to even deal with the officer. cross your fingers, and if you are ticketed, deal with the judge &/or DA… those people are paid more, usually highly respected, and 110% easier to deal with. They don’t need to look like tough guys. How many times do you see a 28 year old rookie judge? you don’t you see older, wiser people who have been around the block more than any cop I know.
