my thoughts exactly lol
I have been around many vehicle transactions, and 99% of the time they go smoothly. Usually, the seller gives the buyer a signed title, a signed bill of sale( stating date, sold to whom, vehicle id#, price, and condition, usually “as is”), and the keys. What does the seller get in return? The Cash! Once money changes hands, game over, buyer owns it, enjoy…
It is a good idea to make a copy of the bill of sale but the seller doesn’t need any proof of transaction. If there is a problem, the burden of proof is on the buyer. If it ever got to court(big IF), the judge would ask the buyer to show proof he got ripped off, and he would have to produce the bill of sale (the only proof that HE has that he gave the seller money) signed by the seller clearly stating price and “as is” condition. Case Closed…
In this case, you are in the drivers seat, you have his money and HIS car. politely tell him to remove his car in x # of days, or as others have said charge him storage. Do not put it in the street and have the city take it as DMV records still have you listed as owner. The city will try to charge You for the towing/storage fees.
If he refuses to take the car, another option is to give the car away for parts Legally you can’t sell it(he has the title) but if the car “goes away” it is not your problem, He owns it, he should keep an eye on it.
In4PartsCar
just got an email from him:
"Jay,
After talking to a couple friends of mine they have some ideas on how to move the air filter away from the wheel well. I am going to take you up on your offer to ship the car to me. Let me know what details you need so we can get the process started."
Looks like he realises i was right.
if he needs freinds to help him decide how to kep an airfilter dry … i dont expect this car to live long …
i know, right? sad, really…
Looks like the coaches email worked.
Now that Johnny Cochran is dead…someone has to be crafty
If the filters wet…the cars upset
 there goes some weight off of your shoulders
that was awesome
- he is still getting an awesome car for the $
had to add that to my sig, lol
LMAO!
You can add it to the list of stupid shit NYS does on a regular basis…
good thing he wants to work it out…but one thing no one mentioned…DON’T video tape you driving the car to show it working…It’s not your car any more. Technically, you’d be driving a stolen car, which is also unregistered.
well the vehical was left in his driveway, so its in his care and therfore allowed to move it at will … all he has to do is videotape it going up and down the driveway a few times and hes all set
if the vehical is still registered in his name with his plates on it, its not stolen either because its technicly still his in the eyes of the state, it doesnt REALY belong to the new owner till its in the new owners name
thats why if you sell a car you must always scrape the Reg from the window, otherwise the new owner can get tickets in your name, and it then becomes your responsibility to prove beyond a reasonable doubt that it was the new owner that got the tickets
recordings arenot usable in court.the other party must know ur taping
technicly, yes, doesnt mean it alays works that way
i think civil cases have more lieint rules for wire taps tho
just incase anyone was wondering…the car ended up being shipped yesterday, so FINALLY everything is taken care of.
glad to hear shit’s done with.
