Wait wait wait… are YOUR plates still on it?
if so, register for another title lol

haha no, my plates aren’t on it anymore, HIS plates from another car are on it (i think, i know he brought plates, not sure if he took them back with him). So i should scrape off the inspection and registration asap then according to that lil blurb from NYS DMV?
I’m not gonna have his car towed, but i will charge him storage if the car isn’t gone within the next week after i get home (i’m still in cali for 2 more days). I’ll get that video of the car driving, with the date on it too.
another point. If for some dumb reason you did give him his money back, now you have to wait on another title, because he signed the original, which could take like 3mos. What the hell are you suppose to do in the meantime. Car’s his end of story.
dont try to screw the kid in any way, but dont let yourself get screwed either
his car pretty much his problem to get it back to his place
Have you TURNED IN your plates @ the DMV? if so, the registration should be null & void anyhow.
Honestly, if he is going to continue to dick around, then I would DEFINATELY remove the registration from the window just to CYA.
for $25 extra You can get a title within a week - at least, this was an option last time i registered a car @ DMV
ok i just got off the phone with my parents, telling them they should surrender the plates…and no my dad says “i’m not exactly sure if he signed the title…” :bloated: so now theres a fucking 50/50 chance that he only signed the bill of sale. Did this just royally screw me over? i know i signed my part of the title before i left ny…and he HAS the title physically. Am i still able to prove its his between that fact and the bill of sale?
shit, I’m not an expert on any of this (i’ve just been reading the DMV site et al), but that can’t help Your position.
I’ll venture to say that IF You
a) Signed & dated the title
b) Signed & Dated the bill of sale
c) He signed & Dated the bill of sale
Then You should be alright. I mean, if You sign the title as a seller, the intent is obviously there… and You do have a reciept saying that he bought it…
2+2=4 I hope.
i’ve also made sure to save all of our emails, the ones confirming his flight here to get the car, terms of payment etc
ok i was just talking some more about this, the bill of sale is what counts, him signing the title is so that he can register the car (ie: u can own a car without it being on the road, right?)
It sounds like You’re prepping for court… but Given all these facts I think You’d have a real solid case.
True…
I bought my project car off of Ebay from a guy in Jersey back in July. I still have the NJ title with his signature and date on it. I just never made it to the DMV to file for a Title (as it wont be registered until spring). So, yea, that makes sense.
This folks is why you always take two copies of the bill of sale and get it notarized. As well as keep a copy of the notarized title.
Just an FYI for future reference.
I’m surprised that NYS doesn’t require either to be notarized in the first place.
good luck hun…man you have bad luck with cars :bloated:
You should have scraped off your registration from the car the moment he signed the bill of sale :gotme:
Inspection sticker doesn’t matter. You could be a nice guy and leave that on.
Or not.
Take a picture of the branch that just happened to fall out of the tree it’s parked under and onto the car and send it to him… ;).
Just kidding of course… good luck with getting this taken care of properly. It’s assholes like that, that like to ruin someones week.
Jay, make copies of the bill of sale. If you have the money already don’t give it back under any cirumstances. Give him untill the end of the week to make a decision, and if he gives you none, have the car towed.
It is not your car anymore as long as you have that bill of sale.
call him on the phone and record the conversation, ask him:
1)if he remembers that you said you had never driving it in the rain
2) if he remembers you saying it was because the filter would get wet
3) clarify what would be needed acoding to the law for it to be a lemon
4) ask him if he understands that that law doesnt apply EVER to used cars
5) inform him of the daily storage fee that the car will start to accumulate if its not picked up in one week
recordings are alays better then paperwork
Put duct tape over the vent and the car is all fixed.
wow - keep this updated, jay man.
still no word…i think i’m gonna email him tommorow asking him when he’s picking up his car
ill take that as meaning he cant find a lawyer that will take his “lemon law” case, lol
