It occurred at Dupont and Dundas West. I was making a left onto Dupont - From Dundas West. The guy plowed into me. Was in the intersection - wating in the left most lane. Saw the light turn red. I was still in the intersection. 2 cars ran the light - moving in the direction that was opposite to myself. Then, when it appeared safe to clear the intersection, this other guy came right through and causing what you see below:
If anyone has any advice to offer, I would appreciate it. This one is going to insco’s for sure - The other car involved was a company car.
She was in mint condition. A couple of folks on this board saw the car in person - and can endorse that statement. I should have gotten her appraised - so I don’t know how to fight this one out in temrs of proving that Azra was in excellent condition. Wishing she can see the road again… But… Difficult to say. The rails looked okay when I saw under her. Will try to get some photos of that and the tower when next I go to the garage. At this time, she is in a garage of my choice - which is not on the insco list.

Even though I was in the intersection on a green? I was waiting for clear passage… Waited up until the light turned red. From what I saw with my lights - two other drivers rushed the light, followed by the guy who hit me. Even then, it is still a partial?
Well, to my knowledge, no charges were laid at the scene. I gave the officer a detailed play-by-play of what I was doing. Forgive me if anything may sound unclear
exact same thing happened to me before, it should have been an improper left turn for me, running a red light for her, but the officer said he was feeling “in the christmas spirit” so he didn’t charge either of us. insurance considered me 100% at fault though.
-whoever does the turning is ALWAYS at fault because you can ONLY proceed when safe to do so… if their speeding ur way running the red u should not have proceeded…
-thats why theres those lines in intersection in downtown toronto… if u are in it at red u get a ticket. also when doing ur G2 or G test or learning instructor, u can remain behind the line until it is clear, you do not need to advance pass the line. if u pass the line and it turns red u fail.
–sorry thats how things are… i hope u dont get a ticket at fault since its NOT ur fault… and ur car is totalled by the looks of insurance. but if u repair urself and get parts here and there it cant be that bad if frame is still good, still gota pull the front end tho…maybe fixable total 1600$ without paint matching? gl i hope u get all ur money back for the car and buy back and part it out
Sorry to say but you are at 100% at fault (as the insurance sees it)
The person making the left turn is always 100% at fault unless you have a witness statement saying that he completely blew the red light and plowed into you. Sad but true.
As much as it sucks they’ll probably charge you as partially at fault if not fully. A friend of mine was involved in a similar accident to this…he was in the intersection making a left, the light turned red, he thought it was safe to go and BAM he gets smoked by a car. He got charged with making an unsafe turn even though the light was red when he got hit.
