Does a Dodge Intrepid even amount to over $1500?

I know if that was in the nyspeed classifieds it would be low-balled to $800

I am assuming thats what kind of car it was, honestly I was more concerned with the damage, I know for a fact it is a 2000 because the collision guy was defensive when I told him insurance wouldnt buy a new rim because it had 1" of paint scuffed on it…

its against the law for an ins company to make them use a specific shop. they are allowed to use any shop they want.

besides that it sounds like a scam. how the hell was the owner/manager of a shop able to get there? doesnt he have a shop to run?

Bottom line, you backed into traffic, she had the right of way. Doesn’t matter if she was trying to scam you, or not paying attention, or didn’t try to swerve… She had the right of way and you were trying to enter the roadway without yielding.

Sounds to me like you were lucky she didn’t call the cops because you’d be looking at some tickets in addition to your insurance paying out to fix her car. At this point let the insurance company decide if her estimate is high. Feel free to tell them the whole thimg seemed sketchy so they’re sure to do their own estimate. I doubt it would be fixed right just by buffing considering how easy cars scratch and you admitting you backed into her while she was moving.

didn’t notice this thread until someone mentioned it in my thread. i was snowblowing my driveway with my car parked in front of my house, across from my neighbors driveway. she backs out, slam! directly into my door moving my car over a foot. she comes over as i didn’t really notice as i was busy with the snowblower. first step was pull out my phone and call the police, she wanted to avoid all that as it was her sons car, blah blah blah… neighbor or not, I AM going to get an accident report. it’s a he said, she said bullshit world without a piece of paper written by an impartial party. gets all her registration info, insurance info, contact info, so it cuts through all the crap if she’s uninsured, and shouldn’t have been on the road putting her at fault. even if it’s your fault call the fucking cops!

regardless you do have to make a reasonable effort to avoid an accident

basically my car was no further into the road than if I had been parked on the shoulder

Argue where the exact placement of your car was all you want. What the insurance company is going to hear is “she had the right of way driving down the road, you were backing out of a driveway into the roadway and had zero right of way”. The matter if inches you’re trying to argue will come down to her word against yours.

You have to try to avoid and accident yes, but you admitted it’s hard to see coming out of the driveway. That means it’s also hard to see a car coming out of that driveway if you’re on the road. Besides that, from your description the damage is on the side of her car and the rear of yours. That means YOU backed into HER. Pretty easy for her to say she had no time to react. It’s not like you backed out in front of her and she drove 50 feet before plowing into you.

You failed to yield the right of way. You will be considered 100% liable for this loss. There is such a thing as last clear chance, but the other driver didnt do anything wrong if she didnt see you coming out of the driveway. Regardless if you hit her or she hit you, you still failed to yield the right of way and you will be considered the proximate cause of this loss. JayS is also correct in saying that your wife will not count as a witness as she is a biased party.

If you called the police, they most likely would have either ticketed you or listed your contributing factors on the police report for failure to yield the right of way or unsafe backing.

If you get your insurance company involved, they will do an estimate of her vehicle, but she has the right to take it to any shop that she likes. The insurance company can not make her use a shop of their choice.

As far as they estimate, when they (your insurance company) writes the estimate, that is all they are going to pay on. Unless the body shop finds more damage when they do the tear down. At that point the insurance company will send the adjuster back out to do a supplement estimate of the vehicle damages and pay for any additional damage found.

No big deal and this is a pretty minor accident. Who is your insurance carrier out of curiousity.
