1st speeding ticket ever--and it sucks

I would plead not guilty and be ready to defend urself. If the cop doesnt show make sure u tell the judge u wnat it thrown out becasue alot of the judges are just tryin to lower it to no points but u still pay a smaller fine. I had just got a ticket foir going 74 in a 55 but being I know the right people the state cop never showed :beer: . No matter what the judges says if the cop doesnt show its has to be thrown out.

Absolutely incorrect if by ā€œjudgesā€ you are referring to ā€œmagistratesā€ as is the concern here.

PA Rule of Criminal Procedure 454(b) states in part

ā€œ(B) in all summary cases arising under the Vehicle Code or local traffic ordinances, the law enforcement officer observing the defendantā€™s alleged offense may, but shall not be required to, appear and testify against the defendant. In no event shall the failure of the law enforcement officer to appear, by itself, be a basis for dismissal of the charges against the defendant.ā€

Now if the Magistrates decision is appealed then the rules change a bit. But then again, most magistartes pretty much do what they please as legal knowledge is not required to hold the position. :nuts:

thereā€™s a magistrate in Brownsville who (i may be off a lil) won election without finishing law school. his dad was the magistrate, and he was a junior, his dad died suddenly and he ran in his dads place. voterā€™s didnā€™t notice the junior, and thought they were re-electing the dad. he won no problem. :blue: hey he let me off a ticket so i think heā€™s A-OK

i had a worse ticket than that. I just asked for mercy and the magistrate lowered it for me. That was over 3 years ago so now i have no record or points. Insurance went down when i switched off of my parents plan, dont understand why tho. and it will go down when i turn 24, i am with erie

Absolutely no law school education is required to be a magistrate. Only have to pass a few day course or at least a brief exam related to one. Must have a law degree to be a judge though.

on the same token, if i were to try and fight this outright-- i.e. no plea bargin, and cross exam the officer. he he starts reading what happened off of either his citation or notes, i could then object to this under grounds that he is not going from recollection. then try to have him say everything from what he remembered, AND HOPE THAT HE CANā€™T, and thus ask that he be struck as a witness due to not knowing the events, or further try to discredit him by askign if he seen anyother vehicles go by, or what style car i was driving and how it appeared, or any other bs question that would try to prove if the oficer was payign attention to that day, or if was just zoned in on me per se.

i dunno. ill just plead not guilty, go to court, and see what happens.

i think clocking is them using a stopwatch.

my guess as to why itā€™s clocking is because he probably used stationary objects instead of ā€˜calibratedā€™ lines painted on the road.

just go in and play on the 1st offence and ask the question, regarding the clocking procedure, in a bashful-type of tone, if you can muster it up, and chances are better for youā€¦ or so iā€™ve been told by magistatesā€¦ then bring up the calibration cycle and it being possibly outdated.

Vascar works by timing someone over a known distance. If the vascar is moving the officer can wait for your vehicle to pass a sign or tree or some known spot and then the officer hits a button which starts the clock. Then when the officerā€™s car passes the same spot he hits a button which starts basically an odometer. Then when you pass another landmark of some sort the officer hits a buttom to stop the clock, then when he passes the landmark he hits a button to stop the odometer. thus he knows how far you went and how long it took you to travel that distance. If the cops have a trap area set up with lines on the road they can just plug that known distance in and just time people. At night, cops often use road signs as landmarks for timing purposes as once you get basically right beside a road sign it will go dark as it is no longer in the cars headlight. Learned most of this from being busted in the past.

This is what I would recommend. Typically the last things magistrates want to see is some smart-ass. Most legal tactics donā€™t really have much use with a magistrate. Also if things go really wrong, you can always appeal the ruling of the magistrate to the court of common pleas where your case is held as if the hearing before the magistrate never occurred. Worst case scenario I would think you get a fine and maybe a couple points, not that I rmember the point system these days.

I got a speeding ticket about a month ago. I was doing 90 in a 65. I had to take a points test and i passed it. They took 2 points off for passing the test and i still have my license. I wish u the best of luck

Yea it was pretty simple. I got 100% .From what penndot told me. The only reason i had to take the test is becasue when u go over 6 points on your record u have to take it :dunno: I had 4 points on my record before the speeding ticket also.

Thats funny I quess from what I have been told in school, by state cops, local cops, and the majestrate is wrong. :rolleyes:
