I’m not saying anything about controlling it. I am saying I have seen a lot of justifications done by insurance companies. This case will settle in the DUI insurace company writing a check to TUSCANI(or her insurance or body shop) for the amount damaged and the deductable…and I will bet on it sight n sound.

I’m not talking about it going to court either.

I’m refering to your comment on the “total control / mebucko” :rolleyes: statement. I’m telling you Insurance companies do use that and thats why it’s never one person’s total fault and can affect who takes liability and who pays for it.

Hell I have seen people with the same insurance company have their insurance just pay for both without assiging fault and then both the people got rate rasies. (it was state farm who did that).

Logically, if this is the whole story, yes it should / will be paid by the other guys insurance. BUT it doesn’t always work like that. Insurance compaines will twist shit so they don’t have to pay if they can.

x2 I would advise them and then I would get a copy of the police report for yourself.

Again with the first person to hit my wife, I went up and had a report 1 hour after the accident. Then called erie and they said they were “having trouble” getting the report and they wern’t sure if they were going to accept liablity. I said bullshit I had the report already and I wanted a rental car for my wife since their client was a fucking moron (stupid bitch took out the whole front of my wifes car.)

A couple nights ago, I got into an accidcent (in my brand new car!). It started when I was racing this guy in a Jetta. We were going up west liberty and all the sudden he slammed on his breaks. To avoid hitting him, I switched in the right lane. I guess he got the same idea to avoid hitting the car in front of him (which happened to be a cop and was the reason of him slamming on his breaks) and he switched right over in front of me. So I ended up rear ending him enough to crack my bumper, push it up into my headlights a little bit, scratch the paint all up, and chip off some of the paint on his back bumper. The cops end up charging him with a DUI, so in their eyes, the accident was probably his fault. Now, the question is, who do you think the liability would fall on according to the insurance companys, considering he was drunk, switched over in my lane, giving me no time to react, and almost rearing a cop? This is a hard one. Either way, I am still getting an aftermarket bumper for my car out of this. :dunno:
