Cops usually don’t witness murders either, but they still charge and convict people for it. It’s probably REALLY obvious that you were guilty. If someone called it in, they have a witness, you at the “scene” with tracks everywhere…come one dude.
Exactly.
However, why would that give them a reason to search the car?
maybe the cop thought they were sloppy donut tracks and therefore had reason to believe he was high.
That’s all it takes.
It doesn’t, but if he cooperated with the officers first (getting out of the car when asked to), then stated in a calm and collective voice that they don’t have authority to search the car, then they likely wouldn’t have. Also, if they found anything illegal in the car, he would EASILY get off on the charges due to illegal search and seizure.
There is a huge gray area around probable cause to search a vehicle. Him acting strange and not co-operating with a pull-over might be enough for it…It’s up to the judge.
Is doing doughnuts in a parking lot even illegal? Can the police ticket you for “reckless driving” in a private parking lot or does that need to be pressed by the owner of the property?
I know the cops were giving stop sign tickets in the parking lot of the Target/Wegmans on Transit at one point.
§ 1100. Provisions of title refer to vehicles upon highways;
exceptions. (a) The provisions of this title apply upon public highways,
private roads open to public motor vehicle traffic and any other parking
lot, except where a different place is specifically referred to in a
given section.
(b) The provisions of this title relating to obedience to stop signs,
flashing signals, yield signs, traffic-control signals and other
traffic-control devices, and to one-way, stopping, standing, parking and
turning regulations shall apply to a parking lot only when the
legislative body of any city, village or town has adopted a local law,
ordinance, rule or regulation ordering such signs, signals, devices, or
regulations.
Unless you own the property they can write you tickets for reckless driving etc on anything open the public.
in drivers ed we were told that they couldn’t ticket you for violations in a parking lot unless that lot is owned by the government (ie town hall, library, court, etc)
I used to work at a place in the plaza on Union across from Galleria Drive. There’s a stop sign there right next to the Holiday Showcase restaurant that probably 1/3 of drivers would blow past because they didn’t see it.
If you stood outside long enough you could probably hear Christmas songs from all of the beeping.
Even after a lot of complaints by managers and workers of the businesses in the area, the cops always said that they couldn’t sit there because the stop sign was on private property.
I am pretty sure that cops can ticket you in a parking lot. I highly doubt that parking lots are free of all traffic laws.
I just posted the section in NYS traffic law that says they can in a parking lot
I don’t read legal jargon
They sure can. I got “imprudent speed” for snow drifting at Wegmans on Transit/Losson.
A Cheektowaga cop was randomly chilling on the side of the building as I flew passed him sideways.
He was REALLY mad, told me to get out of my car with my hands up through his speaker, cuffed me, threated to call a K9 unit and all of this bullshit.
Pretty sure with a little effort you could fight and win pretty much any private lot stop sign violation. NY DOT has very specific rules regarding the placement of stop signs, re: visibility @ distance, reflectivity, height, size etc. If even one of those parameters isn’t met exactly (and they almost never are) I’m sure the ticket would get tossed.
I am working on buying land right now… It will not be built on for 3 years. Shenanigans here we come!!
I do donuts in my parking lot all of the time. :gotme:
I will regularly pull in and whip a 180 in my 2 car wide 4 car long driveway and then back seamlessly into my garage if it’s snowing when I get home. There’s a very good chance that if there was an APD car coming down my street I’d still do it just to see if they’d say anything to me doing it in my own driveway.
It would probably depend on how close to my house I had been fooling around though. Last year I had a cop come ring my doorbell because he followed the drifting tracks right into my driveway (resulted in nothing more than a little chest thumping by a young apd officer who had clearly watched Judge Dread a few too many times). Now I stop driving like an ass when I’m a few blocks from the house.
On a side note, I own 2 commercial strip malls/plazas. Can I do doughnuts in them without getting a ticket?
The real question is CAN I do doughnuts in them?
Police, their only job is to secure enough evidence for a conviction.
