Really though, put yourself in their shoes… would you want some scumbag who fell in your driveway to sue you because he couldn’t walk?

Years ago I hurt my back (out of work). I was unable to return to work for ~3 weeks.

After 3 days off work (paid personal time), I claimed short-term disability. 66.6% of my gross pay.

I don’t know if this is something available to you, but you may want to look into it.

you do realize that its most likely an extension ladder, and not actually 28ft long when your carrying it.

Call the fucking ambulance chasers tell them what happened get their opinion then decide. I am so not the sue type but you need to concider all your options before you decide. When i worked for a shop i had a piece of metal go in the palm of my hand, this is hard to believe but 5-6 years later (not realizing a chunk went it) it came out my finger tip. well to this day when its cold that finger hurts like a bitch due to nerve damage. 20 years later i’m thinkin i shoulda sued.

Take it as a lesson learned. Sometime you slip and fall. It’s winter in WNY, sometimes it’s icy and there nothing that can be done about it. My driveway is a sheet of ice, that you could play hockey on, and there is NOTHING that could be done about it.

try to get compensated for lost wages, dont take it any further.

Ask the employer about lost wages. Don’t do any weird bending or anything so your neck/back heal fully. Hopefully you won’t have on going pain because of this accident.

I lifted a semi clutch wrong at work one day and now I’m in pain everyday ranging from lower back to upper back depending on the day. All I can do is deal with it.

It always happens at the worst time, but suing your work or the home owner isnt going to fix the problem. Workers Comp is your best bet. It may be a tight time for money, but you wouldn’t see a settlement for atleast 3 or 4 years if you were to get one, so that won’t help you really in that aspect right now. The whole process from what I’ve witness is a huge PITA.

if x-ray’s actually came back positive with some injury you’d have a great case…but without that you prob wouldn’t get much.

and whether or not i would do it would depend on:

A - if i am going after the customer, do they seem like a prick? like somebody that can afford it, and would do it to you? i’d use personal judgement…because that is pretty ignorant leaving all that ice around and now shoveling the snow before it gets a chance to harden into ice…or not salting at all.

B - do i hate my employer? if so, sue them. my current employer i wouldn’t think twice before going after if i slip on a walkway or something at work…

fast food and frivolous lawsuits are what this country is built on…

side note:

years ago a neighbor of mine, she was maybe 8 at the time, came into our yard while no parent was home at my house, and her parents were home and let her come over knowing there would be no adult supervision…playing around with her mom’s high heels on thinking she was cool…we had a small jogging trampoline at the time…she was on it in heels 5 sizes too big for her, and she was trying to jump from the trampoline to the swingset and trying to grab it with her hands…needless to say she fell and broke her arm very badly…needed surgery, pins, etc…

we didn’t hear from them for a while, then we got a letter from a lawyer saying they were going after $1,000,000 for pain and suffering of her, emotional distress at not being able to make friends at school due to lack of ability to take part in outdoor activities, and her father had a separate suit against us for a disruption between his relationship with his daughter as caused by the pain she was going through.

we ended up settling out of court, and they ended up moving away since the entire neighborhood hated them, and it’s my understanding that the word spread so fast that even at a new school the girl had trouble making friends because parents were afraid to have her over.

before they moved away though, we made sure to buy a full size 15 foot trampoline, and put it right at the edge of our backyard by theirs, and invite all the other kids in the neighborhood over to play on it, excluding her from all activities.

part of me hates frivolous suits for this reason…but on the same note, part of me feels that since we had to deal with the shit, we’re entitled to some free money as well…so i’m kinda torn on the topic.

Basically if you aren’t injured and are just bruised up, chalk it up to lucky and go on your way. If you are injured or caused damage to yourself that may be long term, then look into it.

Lawyers will tell you that scars = $. Have nothing to show for it other than a temporary bruise, not worth pursuing.

Process will take 3-5 years. Not guaranteed to even win. And if you go through with it and hire a lawyer and lose, you lose $$$$.

Yeah suing for something like that is lame. Your work should pay for lost wages or w/e, But suing is pointless. That’s why they call them accidents. Hell I fell off a tractor at work and sprained my knee this summer and couldn’t work for 4 days. I didn’t sue or anything…I just slipped. Shit happens. I would have sued if it was due to gross negligence on the companies part…but that’s the only reason.

That sucks. I can relate. We just had a guy get hurt today too. He was carrying a ladder and stepped into a hole that he didn’t see.

Workers comp is a PITA and they won’t compensate you 100%. Good luck with everything.

I wouldn’t sue anyone. Especially if you like where you work. If you sue, your days there will be numbered.

I’m not going to read what everyone said, so if it has been said whatever. If your employer pays for your ben’s and are going to have PTO with no permanent injury’s why would you sue?

Take your vacation with a few pain killers and be thankful it wasn’t worse that it was.

good luck getting halsted to pay your medical bills. i just filed with the state and am ready to sue them. this falls under halsteads insurance. tread lightly though. that company is not a fan of work related accidents. if you need to go to there office to fill out the incident report ill take u up there.

how do u get on a second story roof to mount a dish? not everyone wants to pay u to put it in ther lawn and alot of people dont want a 80lbs eye sore on the side of there house.

You don’t get paid for the first 7 days you are out. After that it is somewhere around 2/3 of your regular pay up to $400.00? It does suck but if they paid the total amount, there would be more people trying to milk the system & have no reason to go back. Thats why I purchased supplementary disability ins. Depending on which plan you buy, it can cover the difference between comp/disability, etc & your weekly pay.

Some companies dont want employees to file W/Comp, so they tell them to use their own health ins & the employer will pay the co pay, meds & for their time off. Comp is VERY expensive for employers they’d rather pay “off the books” rather than you file a claim which (depending on how many claims they’ve paid in the past) cause W/C rates to go up.

So you’re saying that you might sue because you could get a payday, not because your employer is at fault? Don’t be that guy.

Just call a lawyer and let them handle the situation, call a reputable one, I can provide you names if you want. The answer is yes you should file suit for any medical costs you have, loss of earning (both current and future). Now you may have to sue your employer, who in turn will file against the home owner; I have no idea.

But call a lawyer, they will advise you; perhaps filing a claim is the proper course of action maybe just workers comp. Talk to someone who does this for a living not amateur hour at NYSpeed

I think it has to be 10 consequtive work days but I may be wrong. About a year ago I had and ingury and I tried filing for disability and was only out for 9 days so I didnt make out. But as for getting 2/3 of the wages I think your right on the money from what I remember.

See what the employer will offer you. If your going to be out for a while I would say file for comp and see what you can make out on. Making a law suite isnt going to get you anywhere IMO, plus if you plan on continuing to work there after you wont look like a huge ass.
