you should still definitely consult with professional legal counsel and get a professional’s opinion.
but, in my opinion (which is far from professional lol), based on the allegations they made, based on what you were charged with, based on what you were NOT charged with, based on the method used to compel your attendance in court… (you said “an appeal” but i think you meant an appearance notice or a promise to appear?)…
…to me all of it seems too much like all the cop really wanted to do was prove a point. (i guess the point being dont get out of the car, heh)
i honestly wouldn’t be surprised, with a half decent lawyer, if the crown withdrew the charges at first appearance.

It’s not that there’s a law against it… its that im sure he’s had bad experiences of people getting out of their cars and causing trouble instead of politely staying inside and being nice blah blah.

They REALLY don’t like you getting out of the car, I bet that is a lot of the reason for why it went down the way it did.
I was with a friend of mine that was pulled over for incorrect plates on his car. For whatever reason, he got out of the car as soon as he pulled over. Both officers immediately pulled their guns and yelled “GET THE FUCK BACK IN THE CAR!”
Needless to say, he got back in the car right quick, haha. The cops told us they are trained to take it as a threat when the person gets out of the car.
Not that it really helps now, but I figured I’d post that up. Best of luck with the situation, I hope the charges get dropped.
It’s a safety thing, cops want you to stay in your car for their own safety… when your seated you have less mobility and they have more control. Its not so much they want to order you around they are looking out for their safety.
Now about your situation… GET professional legal representation asap, you aren’t being charged with a HTA ticket here. Your being charged criminally.
Your lawyer will get disclosure for you and have all the officer’s notes and report regarding the incident. If the story is completely as you described then the Officer’s notes/report will have holes, he would have had to completely make up a story regarding dangerous driving and “made up” stories usually always have holes. Your lawyer’s job would be to exploit those holes and discredit that officer’s notes, once he establishes that your pretty much off the hook. It isn’t something you can do yourself… get a lawyer asap.
Sometimes cops give out bullshit charges to make an example out of you or “power tripping” and many times the cop knows his case is weak and the charges won’t stick but guess what? hes getting paid to goto court and hit you with these charges. You on the other hand are stuck with the stress, time/wage loss, expenses (lawyers etc) they don’t give a shit what it does to you their just assholes like that.
The cop is being an SUPREME a-hole if what you say is true, he decided to hit you with the most severe charge he could logically (in his head, young guy, sporty car hrmmmm) give you and try and make it stick. Your best step from here is get the disclosure and see what kind of story this cop made up regarding “dangerous driving” then go from there… but again this should all be done thru your lawyer.

It basically was a snowball effect of sorts.
First and foremost, the reason they started blaring their sirens at you, I have not clue. It may have been a simple mistake, another red S13 dangerously driving earlier or in the area.
Where you did go wrong was when you refused to stay in the vehicle believe it or not. The officer could have been telling the truth when he said “it could have all been avoided if you stayed in the car”. They do have reasonable power to detain a person for “officer safety” until it has all be sorted out. By refusing their demands, It basically fueled their story/belief that something is not right, gives them “reasonable grounds”. Directly refusing their demands is also a offence of “obstructing justice” or something like that.
When they have believe they have beyond “reasonable grounds” that so and so committed this act they may act on a situation and possibly arrest. At this point they also have the authority the search the immediate scene for evidence, weapons or means of escape.
I know with your innocence and honest confusion it must have been hard to simply stay in the car, I don’t blame you man.
Hopefully this makes sense, and clears things up. Do fight this though.
i had a similar incident today, someone called me and told me cops were fucking with my car in the parking lot. i run to my car and i find them looking at the car all over. got harrased like a motherfu*ker car is stuck with no plates. need to find a cheap flat bed to tow it like 500m from where it is because cops are on my case

Canada doesn’t have Miranda rights. The officer has to inform you of the charge, inform you of your right to obtain counse, and make sure that you understand that. Seems that the officer met the bare minimum. Circumstantional evidence doesn’t meet the requirements of actus reus and mens rea though. Those tire marks will not be fresh, like fresh that day mostl likely. There most likely will not be any witnesses to corrobarate with the officers testimony. Overall, this case seems week. Unfortunately the cop wins to some degree because he gets paid for court, you don’t.
